Can You Smoke in Public in Japan? Rules and Smoking Etiquette Explained

Designated smoking area in Japan

Quick Answer

Yes, but only where smoking is permitted.

Japan does not have a nationwide blanket ban on smoking on every outdoor public street. Instead, national law, local ordinances, and the rules of individual facilities determine where you can smoke.

The national Health Promotion Act generally prohibits indoor smoking in many shared facilities, with specified exceptions. Municipalities can impose additional outdoor restrictions, so the rules change depending on where you are. Health Promotion Act; Ministry of Health, Labour and Welfare guidance.

For visitors, the easiest approach is to find a designated smoking area, check the signs, and follow local rules.

Is Smoking in Public Illegal in Japan?

It depends on the place.

For many workplaces, commercial facilities, and restaurants, the basic national rule is no indoor smoking except in legally permitted smoking spaces.

Schools, hospitals, and administrative government facilities generally have stricter rules: their premises are smoke-free, although qualifying outdoor smoking areas may be permitted under the national system. Local rules and facility policies may be stricter. Ministry of Health, Labour and Welfare.

Outdoor streets are a different matter. Local ordinances may prohibit smoking even where the national indoor restrictions do not apply. There is no single street-smoking rule that you can assume applies throughout Japan. Ministry of Health, Labour and Welfare guidance.

Can You Smoke While Walking in Japan?

Do not assume that walking outdoors makes smoking acceptable. Some municipalities prohibit street smoking whether you are walking or standing still.

In Shinjuku Ward, Tokyo, street smoking is prohibited throughout the ward except in specially designated places. The definition includes smoking while walking, remaining in one place on a road, or riding a bicycle. Both cigarettes and heated tobacco are covered. Shinjuku City.

In Chiyoda Ward, Tokyo, the entire ward except the Imperial Palace is designated as a street no-smoking district. Smoking on roads and in specified public places is subject to a ¥2,000 administrative fine. The rules cover cigarettes and heated tobacco. Chiyoda City ordinance guidance; regulated public places.

In Osaka City, the citywide street-smoking prohibition took effect on January 27, 2025, with a ¥1,000 administrative fine for violations in areas covered by the ordinance. The regulated areas include city-managed roads and other designated areas; “citywide” does not mean every private outdoor property is covered by this particular ordinance. Osaka City.

These are local examples, not a nationwide penalty schedule.

Where Can You Smoke in Japan?

Look for a designated smoking area or smoking room and check its rules before using it.

Useful signs include:

Smoking rooms regulated under the national system must meet the applicable requirements and display the required signs. People under 20 may not enter these smoking rooms, even if they are not smoking. Ministry of Health, Labour and Welfare.

An empty corner, a quiet pavement, or the absence of a nearby no-smoking sign is not enough to establish that smoking is permitted. Check the rules for the location, or ask staff where the nearest smoking area is.

Smoking at Train Stations and on Trains

Check station rules and onboard rules separately. A smoking area at a station does not mean that smoking is allowed on the train.

Tokyo Metro’s history records the introduction of all-day smoking prohibition throughout its stations on January 1, 1988, during the period of its predecessor, Eidan Subway. Tokyo Metro.

On the Tokaido Shinkansen, all onboard smoking rooms were abolished on March 16, 2024. Smoking has not been permitted onboard since that date. JR Central announcement.

The Kyushu Shinkansen also abolished its onboard smoking rooms on March 16, 2024, with smoking prohibited onboard from that date. JR Kyushu announcement.

Older advice telling passengers to “use the smoking room on the Shinkansen” is therefore incorrect for these services. Follow the current signs and announcements for your particular station and train.

Smoking in Restaurants and Bars

Indoor smoking is generally prohibited in restaurants and bars, subject to legally defined exceptions.

Different smoking-room categories have different rules. A smoking-only room does not permit eating or drinking inside, while a designated heated-tobacco smoking room can allow eating and drinking under the transitional system. Ministry of Health, Labour and Welfare.

Certain qualifying existing small restaurants can use a separate transitional category called a 喫煙可能室 (smoking-permitted room). Despite the word “room,” this can cover all or part of the establishment, and food and drinks may be served there. It does not mean that any small restaurant can simply choose to allow smoking: eligibility and other legal requirements still apply. Ministry of Health, Labour and Welfare restaurant guidance.

Local restrictions may narrow these exceptions. In Tokyo, restaurants that employ staff cannot use this particular smoking-permitted-room exception under the metropolitan ordinance. That does not mean every other legally permitted smoking-room category is unavailable. Ministry of Health, Labour and Welfare explanation of Tokyo’s additional rule.

Before entering, check the smoking signs. If you want a smoke-free meal, ask whether smoking is allowed anywhere in the dining area.

What Happens If You Smoke Where It Is Prohibited?

The consequences depend on the rule and the location. Osaka City’s ¥1,000 street-smoking administrative fine and Chiyoda Ward’s ¥2,000 fine are examples of municipal enforcement, not amounts that apply everywhere in Japan. Osaka City; Chiyoda City.

The Health Promotion Act also provides for administrative fines. For smoking in a prohibited place, the provision for a fine of up to ¥300,000 is linked to failure to obey an order issued under the Act. It is not an automatic nationwide fine for lighting a cigarette outdoors. Health Promotion Act, Articles 29 and 77.

Smoking Etiquette and Legal Responsibilities

Local smoking bans and facility rules tell you where smoking is prohibited. Consideration for other people also matters where smoking is permitted.

This is more than etiquette: Article 27 of the Health Promotion Act requires smokers to consider their surroundings so that they do not cause unwanted secondhand smoke. Health Promotion Act.

Official guidance gives examples such as choosing a place away from other people and avoiding smoking near children, patients, or places where these groups gather. Ministry of Health, Labour and Welfare guidance.

Being outside a designated no-smoking zone does not remove that responsibility.
